All disputes arising from the execution of，or in connection with this contract shall be settled through friendly negotiation between both parties hereto. In case no settlement to disputes can be reached through friendly negotiation，the disputes shall be submitted to the China International Economic and Trade Arbitration Commission for arbitration in accordance with the Arbitration Rules and the Procedure for the said Commission。
3. 明確仲裁裁決的效力，仲裁費(fèi)用的承擔(dān)以及一方不履行裁決的法律后果等。
仲裁的裁決是終局的，對(duì)雙方當(dāng)事人具有同等的約束力，如一方當(dāng)事人不服，不得申請(qǐng)法院變更，但如果一方當(dāng)事人不履行裁決，另一方有權(quán)向有管轄權(quán)的法院 (a court at a place of jurisdiction)申請(qǐng)執(zhí)行。關(guān)于仲裁費(fèi)用，一般應(yīng)由敗訴方負(fù)擔(dān) (to be borne by the losing party)，這種做法對(duì)于防止違約有威懾作用。
【例3】
仲裁裁決是終局的，對(duì)簽約雙方均有約束力，任何一方不得向法院申請(qǐng)變更。仲裁費(fèi)用，除仲裁機(jī)構(gòu)另有決定外，均由敗訴方負(fù)擔(dān)。雙方應(yīng)按規(guī)定的期限履行仲裁裁決，如果其中一方逾期不履行裁決，另一方有權(quán)向有管轄權(quán)的法院申請(qǐng)執(zhí)行。在仲裁期間，除正在仲裁的部分外，雙方應(yīng)繼續(xù)執(zhí)行合同的其余部分。
The arbitration award shall be final and binding upon both contracting parties. Neither party shall seek recourse from a Court of Law for revising the decision. The arbitration expenses shall be borne by the losing party unless otherwise awarded by the said Arbitration Organization. Both parties shall fulfill the arbitration award in accordance with the time limit stipulated. Should one of the parties not fulfill the award after this time limit，the other party shall have the right to apply for fulfillment to court at a place of jurisdiction. In the course of arbitration，this Contract shall be continuously executed by both parties except the part of this contract which is under arbitration。
