【例3】
中標(biāo)者在收到中標(biāo)函后于兩周內(nèi)自費(fèi)取得履約保證，辦理有信譽(yù)銀行的履約保證。其金額為合同價格的XX%，保證按時履行本合同。
The successful tender shall, within two weeks of the issue of a Letter of Acceptance ，at his own expense obtain in the form of a performance Bond，the guarantee of a reputed bank in a sum equivalent to XX percent of the contract price for the due performance of the contract.
由于合同中雙方當(dāng)事人的權(quán)利與義務(wù)是對等的，一方的權(quán)利是另一方的義務(wù)， 同時，一方的義務(wù)又是另一方的權(quán)利。因此，合同各方為確保自己權(quán)利的實(shí)現(xiàn)，都可以要求另一方設(shè)立履約擔(dān)保（銀行保函）。在銀行的保函中，應(yīng)明確合同規(guī)定的各 項(xiàng)義務(wù)和時間以及擔(dān)保銀行的保證條件等。下面是一例銀行

We, the undersigned guarantee herewith to your company that the sum of USD remuneration for the first phase will，after it has been paid to___，be refunded to your company against written notification issued by your company if the obligations incumbent upon the party signing the Contract (___Company) in accordance with the Contract are not duty fulfilled.
